1. Acceptance of the Terms
These Terms of Use (“Terms”) govern access to and use of the website and services offered through ProductImageFix and the domain productimagefix.com (“Service”).
By accessing the website, creating an account, uploading images, purchasing image credits, subscribing to a plan, downloading processed files, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Operator of the Service
The Service is operated by Brandonn – Sole Proprietor, identified in the Legal Notice available on the website.
3. Nature of the Service
ProductImageFix is an online image preparation tool designed to help marketplace sellers transform product photos into cleaner listing-ready images.
The Service may include features such as image upload, automatic product centering, background replacement or cleaning, square-format output, batch processing, result storage, ZIP downloads, single-image downloads, account management, billing, subscriptions, and related tools.
The Service is intended to simplify repetitive image preparation tasks. It is not an official tool of Amazon, eBay, Etsy, Shopify, or any other marketplace.
4. No Marketplace Approval Guarantee
ProductImageFix helps create clean, white-background product images, but the operator does not guarantee that any image will be accepted by Amazon or any other marketplace, advertising platform, payment provider, distributor, or commercial partner.
Marketplace rules may vary depending on the platform, product category, country, seller account, image content, file requirements, and review process. You remain solely responsible for checking that your final images comply with all applicable marketplace rules before publication.
5. Eligibility
You represent and warrant that you are legally capable of entering into a binding agreement and that your use of the Service complies with all laws and regulations applicable to you.
If you use the Service on behalf of a company, organization, agency, seller account, or other entity, you represent that you have authority to bind that entity to these Terms.
6. Account Registration and Security
Certain features may require an account, including paid credits, subscriptions, billing history, invoice access, credit balance, and result management.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account, except where caused exclusively by the operator’s fault.
You must immediately notify the operator of any unauthorized access, suspected breach, payment issue, or misuse of your account.
7. Public Free Test
The Service may offer a limited public free test allowing visitors to process a limited number of images without an account.
Free access is provided for testing purposes only. The operator may modify, suspend, restrict, reduce, or remove free access at any time, including to prevent abuse, excessive use, automated scraping, fraud, or technical overload.
Free test limits may be enforced through cookies, local storage, IP-based limits, browser identifiers, account checks, server-side rules, or other technical measures. Attempting to bypass these limits is prohibited.
8. Credits, Packs, and Subscriptions
Some features of the Service require paid image credits, one-time packs, subscriptions, or other paid access mechanisms.
Unless otherwise stated, one successfully processed image consumes one image credit. A credit may be consumed when a conversion is successfully completed and a downloadable result is made available.
If a conversion fails due to a technical error and no usable result is produced, the operator may decide not to consume a credit, restore a credit, retry the operation, or provide another reasonable solution.
One-time packs grant a fixed amount of image credits. Subscription plans grant a recurring amount of image credits according to the selected plan and billing period.
Subscription credits may be subject to plan limits, rollover limits, maximum balance caps, expiration logic, cancellation rules, and other rules shown on the pricing, checkout, billing, or account pages.
The operator may modify pricing, credit quantities, subscription terms, included volume, limits, or available packs at any time. Changes do not affect already completed purchases except where required for legal, technical, security, payment, or abuse-prevention reasons.
9. Payments and Billing
Payments may be processed by third-party payment providers. The operator does not store full payment card details unless explicitly stated through a secure payment provider flow.
You agree to provide accurate billing information and to keep your payment method valid where a subscription is active.
Invoices, receipts, subscription status, and billing history may be made available through the user account or by the payment provider.
The operator may suspend or restrict access to paid features in case of failed payment, chargeback, suspected fraud, abuse, payment dispute, or breach of these Terms.
10. Right of Withdrawal and Digital Performance
Where you purchase digital services as a consumer, mandatory consumer protection rules may apply, including rules relating to pre-contractual information and the right of withdrawal.
Where permitted by applicable law, by purchasing image credits, one-time packs, subscriptions, or immediate digital processing services, you may be asked to request immediate performance of the Service and to acknowledge that your right of withdrawal may be affected once the digital service has begun, credits have been made available, or processing has started.
Nothing in these Terms limits any mandatory, non-waivable consumer rights that you may have under applicable law.
11. Refunds
To the maximum extent permitted by applicable law, purchases relating to digital credits, processed images, subscriptions, and digitally delivered services are non-refundable once the digital service has begun, the credits have been granted, processing has started, or the Service has been made available.
The operator may, at its discretion, issue refunds, credits, retries, or commercial gestures in specific cases, including proven technical failure, duplicate payment, billing error, or exceptional circumstances.
Any voluntary refund or commercial gesture does not create an obligation to provide the same remedy in other cases.
12. User Uploads
You are solely responsible for all images, files, filenames, metadata, product photos, logos, marks, text, and other materials that you upload or submit to the Service (“Uploads”).
You represent and warrant that you have all rights, licenses, permissions, and legal bases necessary to upload, process, transform, store, download, and commercially use your Uploads and the resulting processed images.
This includes, where applicable, rights relating to intellectual property, trademarks, product packaging, copyrighted works, design rights, trade dress, personal data, image rights, privacy rights, and confidential information.
The operator has no general obligation to verify the legality, ownership, authenticity, or commercial accuracy of your Uploads.
13. Processed Images and Results
The Service may create processed images, edited versions, square-format files, white-background files, cropped files, resized files, compressed files, previews, thumbnails, ZIP archives, or other downloadable results (“Results”).
Results may contain visual imperfections, incorrect cropping, inaccurate centering, incomplete background removal, artifacts, compression effects, color shifts, missing details, or other unexpected changes.
You remain solely responsible for reviewing all Results before using, publishing, uploading, selling, advertising, or distributing them.
The operator makes no warranty that any Result will be accurate, error-free, commercially suitable, legally compliant, non-infringing, or accepted by any marketplace.
14. Rights in Uploads and Results
As between you and the operator, and subject to applicable law and third-party rights, you retain ownership of your Uploads.
Subject to your compliance with these Terms, you may use the Results for your own personal, professional, e-commerce, marketplace, catalog, advertising, or commercial purposes, provided that such use complies with applicable laws and third-party rights.
The operator does not grant you any rights in third-party trademarks, copyrighted works, designs, product packaging, logos, brand assets, or other protected elements that may appear in your Uploads or Results.
15. License Granted to Operate the Service
You grant the operator a non-exclusive, worldwide, royalty-free license, for the duration necessary to provide the Service, to host, store, reproduce, process, transmit, transform, resize, crop, compress, display, and technically use your Uploads and Results solely for purposes such as operating the Service, creating requested Results, enabling downloads, troubleshooting incidents, preventing abuse, ensuring security, handling billing disputes, complying with legal obligations, and improving service reliability.
This license does not authorize the operator to sell your Uploads as stock images or to claim ownership of your product photos.
16. Storage and Availability of Results
The Service may temporarily store Uploads and Results to allow processing, previewing, refreshing, downloading from another device, account access, support, security checks, and technical troubleshooting.
The operator does not guarantee permanent storage of Uploads or Results. You are responsible for downloading and backing up any files that you wish to keep.
The operator may delete Uploads, Results, previews, thumbnails, archives, jobs, or inactive data at any time, including for storage management, security, legal compliance, account closure, abuse prevention, or service maintenance.
17. Acceptable Use
You agree not to use the Service:
- for any unlawful, fraudulent, abusive, deceptive, or harmful purpose;
- to upload or process content that infringes intellectual property, trademarks, privacy rights, image rights, trade secrets, or other third-party rights;
- to create, improve, disguise, sell, or promote counterfeit goods, illegal goods, stolen goods, or prohibited products;
- to misrepresent the nature, origin, quality, condition, safety, certification, or legality of a product;
- to process images containing illegal, exploitative, hateful, violent, defamatory, harassing, non-consensual, or otherwise prohibited content;
- to impersonate another person, brand, seller, manufacturer, marketplace, or organization;
- to create or distribute malware, phishing material, scams, spam, or harmful code;
- to reverse engineer, scrape at scale, overload, disrupt, probe, or interfere with the Service;
- to bypass credits, payment logic, public test limits, rate limits, authentication, security controls, or access restrictions;
- to use automated systems, bots, scripts, or bulk tools in a way that exceeds normal use or harms service stability;
- to use the Service in a way that may expose the operator to legal, regulatory, payment, reputational, or security risk.
18. Product Listings and Commercial Responsibility
ProductImageFix only assists with image preparation. It does not verify your product, your listing, your claims, your seller account, your marketplace compliance, your legal obligations, or your right to sell a product.
You remain solely responsible for all product listings, product descriptions, claims, certifications, safety warnings, taxes, consumer information, intellectual property checks, and marketplace compliance obligations associated with your products.
19. Reporting Abuse or Rights Violations
Users, rights holders, consumers, or authorities may report content, activity, accounts, uploads, or results believed to be illegal, infringing, abusive, fraudulent, or in violation of these Terms by contacting the operator through the contact details made available on the website.
Reports should contain sufficient information to identify the content, account, transaction, or activity concerned and explain the reason for the report.
The operator may review and act on reports in its discretion and in accordance with applicable law.
20. Moderation and Enforcement
The operator may, at any time and without prior notice, monitor, block, refuse, remove, delete, restrict, suspend, disable access to, retain for evidence, or review any account, Upload, Result, job, transaction, download, or activity if reasonably considered necessary for safety, legal compliance, intellectual property protection, anti-fraud measures, platform integrity, payment protection, abuse prevention, or risk management.
The operator may suspend or terminate access immediately in case of suspected misuse, payment incident, chargeback, legal claim, security risk, attempted circumvention, prohibited content, repeated failures, or breach of these Terms.
21. Preservation of Evidence and Cooperation
The operator may preserve relevant logs, metadata, upload records, processed files, transaction records, account identifiers, technical records, security events, moderation records, and support exchanges where reasonably necessary for security, fraud prevention, legal compliance, dispute handling, enforcement of these Terms, or cooperation with competent authorities or rights holders.
22. Third-Party Providers
The Service may rely on third-party providers for payment processing, hosting, storage, image processing, email delivery, analytics, monitoring, security, CDN delivery, and other technical or business functions.
Certain features, prices, limits, availability, processing times, file compatibility, and payment flows may depend on those third parties and may change without notice.
The operator is not responsible for third-party outages, delays, errors, security incidents, payment refusals, provider limitations, or changes outside its reasonable control.
23. Service Changes
The operator may modify, replace, suspend, discontinue, restrict, or update any part of the Service, including features, pricing, credit rules, free limits, file formats, batch sizes, upload limits, storage duration, result quality, interface, download methods, and technical specifications, at any time.
The operator shall not be liable for the removal, unavailability, replacement, or evolution of any feature, dependency, workflow, or provider.
24. Intellectual Property of the Service
The Service itself, including its design, code, structure, brand, logo, name, databases, interfaces, workflows, documentation, text, graphics, and non-user content, remains the exclusive property of the operator and/or its licensors.
Except as expressly permitted, no license or right is granted to you by implication or otherwise.
25. Privacy
Use of the Service may involve the processing of personal data and technical identifiers. Please refer to the Privacy Policy and Cookie Policy for information about how personal data, cookies, uploads, account data, payment data, and technical logs are handled.
26. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
The operator disclaims, to the fullest extent permitted by law, all warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, security, compatibility, accuracy, reliability, error-free operation, marketplace acceptance, and commercial performance.
27. Limitation of Liability
To the fullest extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of sales, loss of savings, loss of business opportunity, loss of data, loss of content, reputational damage, marketplace suspension, listing rejection, advertising rejection, or interruption of activity.
This includes, without limitation, damages resulting from processed images, user reliance on Results, marketplace decisions, content claims, third-party provider failures, file loss, account suspension, loss of access, moderation actions, payment issues, or changes to the Service.
Subject to mandatory legal rules that cannot be excluded, the operator’s total aggregate liability for all claims arising out of or relating to the Service shall not exceed the total amount paid by you to the operator during the three (3) months preceding the event giving rise to the claim.
28. Indemnification
You agree to defend, indemnify, and hold harmless the operator and its partners, service providers, subcontractors, and licensors from and against any claims, actions, proceedings, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use or misuse of the Service;
- your Uploads or Results;
- your product listings, marketplace activity, advertising, or commercial use of Results;
- your breach of these Terms;
- your violation of any law, marketplace rule, or third-party right;
- your attempt to bypass payments, limits, credits, or technical controls.
29. Termination
The operator may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if reasonably necessary for security, compliance, abuse prevention, payment enforcement, risk control, or breach of these Terms.
Upon termination, your right to access and use the Service ceases immediately. Clauses which by their nature should survive termination shall survive, including liability limitations, indemnity, intellectual property, governing law, dispute clauses, payment-related provisions, evidence preservation, and rights relating to Uploads and Results.
30. Governing Law and Jurisdiction
These Terms are governed by French law.
Subject to mandatory consumer protection rules, any dispute arising from or relating to these Terms or the Service shall be submitted to the competent French courts.
31. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
32. No Waiver
Any failure by the operator to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other provision.
33. Changes to the Terms
The operator may update these Terms at any time. The version published on this page is the version currently applicable.
Continued use of the Service after an update constitutes acceptance of the revised Terms.
